General Terms and Conditions (GTC)

§ 1 Scope and Provider

These terms and conditions govern the contractual relationship between the operator of Mallorca-Zero (hereinafter "Provider") and the users (hereinafter "Users") of the online platform. By registering or using the services, the user agrees to these conditions.

§ 2 Description of Services

Mallorca-Zero is a regional online marketplace that exclusively focuses on offers and requests related to the island of Mallorca. The provider only provides the technical platform on which users can create and publish ads. Contracts initiated by these ads are concluded exclusively between the respective users.

§ 3 Registration and User Account

Use of certain functions (e.g. placing ads) requires registration.
The user is obliged to provide truthful information and keep their data up to date.
Each user may only create one user account. Registering multiple accounts is prohibited.
The access data must be kept confidential and not shared with third parties.

§ 4 Principles of Ad Placement

The user undertakes to adhere to the following principles when designing and publishing ads:

Regional Relevance: Only ads directly related to Mallorca are permitted. Offers for real estate, jobs, or services outside Mallorca are not allowed.
Categorization: Ads must be placed in the appropriate category.
No Duplicates: Posting identical or nearly identical ads multiple times is prohibited.
Copyrights: The user warrants that they have all rights to the texts and images published. The use of third-party photos (e.g. copied from the internet) is prohibited.

§ 5 Prohibited Content

It is prohibited to publish ads that violate legal regulations, third-party rights, or good morals. In particular, the following content is prohibited:

Pornographic, youth-endangering, or violence-glorifying content.
Discriminatory, offensive, or racist statements.
Weapons, drugs, or illegal substances.
Gambling, pyramid schemes, network marketing, or pure affiliate advertising.
Offers that solely serve to advertise external websites or online shops without presenting a specific local offer.

§ 6 User Rights and Indemnification

By posting content, the user grants the provider the right to make these contents publicly accessible and distribute them on the platform.
The user indemnifies the provider from any claims that third parties may assert due to the infringement of their rights by the content posted by the user. This also includes the costs of necessary legal defense.

§ 7 Fees

The basic use of Mallorca-Zero is free of charge. Fees may apply for certain additional services (e.g. highlighting ads) or commercial use. The user will be clearly informed of fee-based services before use.

§ 8 Measures in Case of Violations

In case of violations of these terms and conditions or justified suspicion of abuse, the provider is entitled to:

Delete or modify ads without prior notice.
Warn users.
Temporarily or permanently block the user's access.

§ 9 Limitation of Liability

The provider does not guarantee the accuracy, completeness, or timeliness of the content provided by users. The provider is only liable for damages resulting from the use of the platform in cases of intent or gross negligence.

§ 10 Final Provisions

The laws of the Federal Republic of Germany (or Spain, depending on your company's location) apply. Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected. The provider reserves the right to change these conditions at any time. Changes will be communicated to the user before they take effect.
